There are 3 main stages for getting a legal job in China:
1) to be issued with a Chinese working visa, also called Z visa, for entering China
2) to be issued with a working card (工作证) and alien employment permit (就业许可证)
3) to get the residence permit (居留许可) sticker stamped (pasted) into your passport in the local public security authorities.
The key supporting document for a Chinese working visa is an invitation letter provided by an employer in China. The employer, in its turn, must have an alien employment license, i.e. be accredited for hiring any foreign nationals.
For getting an alien employment permit, the employer should submit the legalized diploma of a potential employee to an immigration service authority.
Then the employer shall send the original of the alien employment permit issued by the Ministry of Human Resources and Social Security of PRC and the original of invitation letter to the employee.
After entering into China with a Z visa, a foreign employee shall be issued with a working card (工作证), which has a form of a green document, and alien employment permit (就业许可证). A working card issue requires the following documents: the employment order, CV, passport (the original and a translated copy), photo, the employer business license.
Then, together with your employer, a lawyer or a representative of the law firm, which provides support for the employer’s business, you shall complete the form in Chinese and submit all the documents to the Administration for Industry and Commerce.
Once the working card is issued, you should apply for an alien employment permit (就业许可证) with the same documents package and also with the original and copy of the working card attached.
Those, who received Z visa, should apply for temporary residence permit (居留许可 stating 任职) to the local entry-exit administration of the public security authority (as per the place of residence) within 30 days upon entry to China.
Temporary residence permit shall be pasted into your passport as a sticker and be valid up to a year, depending on your employment agreement terms and conditions. Application for renewal of your temporary residence permit shall be submitted a month prior to its expiry date.
If a foreign national fails to observe the rules for staying in China, the police will issue an order asking him or her to leave within the specified term (no more than 15 days). If a foreign national fails to leave China within the specified term, he or she shall be subjected to deportation. In this case, the foreigner will be banned from re-entering China for the period from 1 to 5 years. All the costs, associated with deportation, are usually borne by the foreign national. However, if he or she is unable to pay the amount, all the costs will be borne by the employer, who illegally hired the foreign national.
