Who can apply for “Employment” visa for working in India?

Only qualified specialists of the following categories (not clerks and not secretaries) may pretend to work in India: 
— contract advisors, who will get a fixed salary from the company in India, 
— artists, engaged in regular performances of the whole period of validity of the employment contract, concluded with a hotel, club or other organization, 
— coaches of National level teams or famous sport clubs, 
— sportsmen, who concluded a contract with a sport club or sport organization, 
— Individual Entrepreneurs, who come to India in order to render engineering, medical, accounting, legal and other qualified services as independent advisors,  
— teachers of foreign languages and translators/interpreters, 
— engineers and technical workers, who come to India for assembling and launching equipment, for rendering technical support, transferring know-how, who shall get a fixed salary from an Indian company. 

ATTENTION: The salary under contract between an Indian company and a foreign employee shall not be less, than 25.000 $ a year. This rule doesn’t apply to ethnical cooks, translators and diplomatic missions employees.

Conditions for getting a working visa in India

1. An applicant shall be a highly qualified professional, who’s hired by an Indian company under contract basis or employment conditions.  
2. A working visa isn’t issued to foreigners, who want to get a job, for which there are qualified Indians. 
3. A working visa isn’t issued to foreigners, who want to do not qualified works. 

What period if a working visa in India issued for?

The term, for which “Employment” visa is issued for, may be the following:

- for technicians experts, who come to India to work in compliance with bilateral agreement between the Government of India and foreign Government, or in compliance with the cooperation agreement, approved by the Government of India, may get visa in India for the period of agreement validity or for five years (a shorter period prevails, there is a possibility of multiple entries),
— if foreign employees will work in the area of software development or informational technologies, a Consulate may issue a working visa for the period up to 3 years or for the period of work (a shorter period prevails, there is a possibility of multiple entries),  
— a foreigner, who come for a work, not specified above, may get a working visa for the period up to 2 years or for the period of work in India (a shorter period prevails, there is a possibility of multiple entries),
— Governments of States/FRRO may extend the initial period of working visa validity, but the total period of visa validity shall not exceed 5 years from the moment of its issue. A visa shall be extended every year. A positive decision on visa extension is accepted, if a foreigner observes laws of India and provides documents, confirming job, and also Income Tax Declaration.
